Juvenile Case

October 29, 2008

In many instances, school staff such as principals and officials at school can search a student’s backpack.  If charged with a crime, students can be arrested just like adults.  They are handcuffed and walked out of the school and taken to a juvenile detention center if bond is not posted.  Students will have access to judges, hearings, and typical remedies of the judicial system.  Families of the kids can hire defense attorneys to help mount a defense.

Substance Abuse and Alcohol

October 21, 2008

Driving While Intoxicated, in Texas is operating a motor vehicle while under the influence of alcohol or other intoxicants.  A breath test result of .08 or higher is presumed intoxication.  If you have been pulled over and took a breath test, contact a defense attorney immediately.

Possession of Drugs

October 10, 2008

In Texas, several people in one vehicle can be charged if one person in the car has drugs.  A great criminal defense attorney will try to fight the charges if you are one of the unlucky individuals riding in the car.  For that matter, even if you are the person with the drugs, you should always contact a criminal defense attorney and seek good legal advice immediately.  This is purely informational and meant for the general public.  If you have a case, you should seek representation and legal advice.

DWI, what to do?

October 8, 2008

I am frequently asked by family and friends what one should do if stopped by police for driving while intoxicated (DWI), commonly referred to as drunk driving.  First and foremost, do not take any of the tests.  You have the right to remain silent and can exercise that right.  If you are arrested, you will be taken to jail and can bond out using a bail bond company or by paying the bond yourself.  Bond is typically low if this is the first time you’ve been arrested.  Next, call a lawyer.  It is important, particularly with a DWI to get in touch with a good, experienced criminal defense attorney within 14 days.  This is not intended to substitute for legal advice or representation.  You should consult with an attorney for legal advice on your case.
